The Delhi High Court has sought the views of Indian Government in response to two petitions regarding recognition of same-sex marriages in India under the Special Marriages Act and the Foreign Marriage Act (FMA)
The Govt of India today opposed a petition seeking recognition of same-sex marriages under the Hindu Marriage Act 1954, telling the Delhi High Court that "Our culture and law don't recognize the concept of same-sex marriages".
The PIL states that Section 5 of the Hindu Marriage Act does not distinguish between a homosexual and heterosexual couple, and hence homosexual couples should also be recognised under the Act.
