SC Refuses To Review Section 377 Verdict

The Supreme Court today refused to review its recent verdict recriminalizing homosexuality, throwing out the review petitions filed by the government and queer-rights bodies.

Justice HL Dattu and Justice SJ Mukhopadhyaya, who heard the plea for review in private chambers without lawyers present, didn’t accept the Centre’s plea that the verdict was not constitutionally sound.

With this decision, the only legal recourse left is a curative petition in the Supreme Court. Senior advocate Harish Salve said the matter should have been heard by a 5-member bench of the Supreme Court.
