NAZ Foundation Files Curative Petition In Supreme Court Against Sec 377 Verdict

Naz foundation on Monday filed a curative petition in the Supreme Court asking it to correct its December 11 verdict which upheld Section 377 of the IPC that criminalizes adult consensual sexual same-sex acts. The other petitioners in the case are expected to file their petitions this week.

The curative petition is the last resort before the SC, usually exercised when all other options have been exhausted. Curative petitions aren’t generally heard in open courts. The SC had previously dismissed a review petition on the same matter.

The petition highlights many errors on the face of record, most pertinently, the failure of the court to see the discriminatory nature of the law towards the queer community.
